Hawaii law explicitly forbids employers from requesting or considering a prospective employee's prior salary, benefits, or other compensation history when making hiring decisions or determining starting pay. HRS § 378-2.4 - Wage history inquiries; prohibited.
It shall be an unlawful discriminatory practice for any employer to:
(1) Inquire about a prospective employee's wage history; or
(2) Rely on a prospective employee's wage history in determining the prospective employee's wages, benefits, or other compensation during the hiring process, including salary negotiations.
This section shall not apply to any voluntary and unprompted disclosure of wage history information by a prospective employee. Nothing in this section shall be construed to prevent an employer from discussing with a prospective employee the prospective employee's expectations with respect to salary, benefits, and other compensation, including any compensation offered in a prior position.
Scope and Exceptions
